Civil Rights and Constitutional Law
We represent business, individual, institutional, municipal and law enforcement clients in claims of discrimination based on age, sex, race, religion and disability, harassment, and allegations of constitutional violations.
We have experience in defending claims under 42 USC 1983 for excessive force, unconstitutional policies and procedures, failure to train, and other civil rights claims. Our team provides compliance counseling, proactive legal training, and litigation services regarding civil rights claims to a broad array of governmental clients and private employers. We will work with you in administrative and/or court proceedings to dispose of frivolous matters through dispositive motions, resolve legitimate claims where appropriate or defend you through trial and any subsequent appellate proceeding (if necessary).
Employment Law
We represent businesses, institutions and municipalities in all aspects of employment law including preventive measures, training for managers and supervisors, contracts, manuals and policies, worker’s compensation, Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act, as well as claims arising under the New Mexico Human Rights Act, workers’ compensation laws, breaches of employment contract, and collateral torts such as retaliatory discharge.
When litigation is unavoidable, we bring our clients the experience and resources to effectively and efficiently resolve disputes. We defend employers against claims of defamation, whistleblower retaliation and discrimination. We also defend employers against other employment-related lawsuits including breach of contract, breach of implied contract, breach of implied covenant of good faith and fair dealing, wrongful discharge, and constructive discharge.
We help our clients avoid litigation by drafting personnel policies, review existing personnel policies, conduct trainings on personnel and human resource issues, conduct investigations and respond to charges of discrimination.
We have defended cases in New Mexico’s federal and state courts and have appeared in front of the New Mexico Human Rights Bureau (“HRB”), the Equal Employment Opportunity Commission (“EEOC”), and the State Personnel Board. We defend claims before the EEOC and HRB.
Insurance Law
We defend insureds in lawsuits involving motor vehicle accidents, premises liability, legal and medical claims, civil rights actions, aviation accidents, construction and property claims, environmental matters, products liability, and malpractice matters, subrogation and insurance coverage issues.
Guardian Ad Litem
We also serve as Court-appointed Guardian Ad Litem (GAL). Please contact our office if you are interested in appointing us as a GAL to represent minor children in personal injury litigation.
